Dying Matters Awareness Week which takes place from 5th-11th May is an annual campaign aimed at encouraging open conversations about death, dying and bereavement. Whilst this is a typically uncomfortable topic to think and indeed talk about, planning for the future is one of the most important, responsible and caring things you can do for yourself and your loved ones.

Starting the Conversation: Breaking the Taboo Around Death

One of the biggest challenges people facing is starting conversations about their end-of-life plans with family and friends. Many people avoid the subject because they don’t want to upset their loved ones or feel it’s too early to think about it. However, discussing these matters, and making sure to discuss them well in advance of a crisis occurring, allows you to express your wishes clearly and prevents confusion and disputes later.

How to Start the Conversation

  • Choose the right time and place – A relaxed setting, such as a family dinner or a quiet walk, can help to create a more open atmosphere for discussion.
  • Use Prompts to ease into the topic –You could mention a news story, a friend’s experience, or an upcoming event such as Dying Matters Awareness Week to introduce the subject naturally.
  • Be clear about your wishes – Explain why it’s important to you to have a will or a power of attorney in place, and reassure your loved ones that these steps are about protecting them as much as yourself.
  • Encourage others to share their thoughts – It’s a two-way conversation; understanding what matters to your family can help shape your own plans.

Planning Ahead: Wills, Lasting Power of Attorney and End-Of-Life Wishes

Making or Updating your Will

A Will is one of the most important documents you can create. It ensures that your estate is distributed according to your wishes and prevents unnecessary stress for your loved ones after your passing.

If you don’t have a Will, the law dictates who inherits your assets, which may not align with your preferences. This can cause unintended consequences, such as estranged family members inherited your estate or your partner being left without legal protection.

If you already have a Will, it is essential to review and update it regularly. Significant life events – such as marriage, divorce, the birth of children or grandchildren, or acquiring new assets – can affect your Will’s validity or relevance.

Lasting Powers of Attorney: Ensuring Your Wishes Are Respected  

A Lasting Power of Attorney (LPA) allows you to appoint someone you trust to make decisions on your behalf if you lose mental capacity due to illness, injury or age –related conditions. It’s important to know that there are two types:

  1. Health and Welfare LPA – Covers decisions about medical treatment, living arrangement, end of life care.
  2. Property and Financial Affairs LPA – Allows your chosen attorney to manage your finances, pay bills and handle property transactions.

It’s also important to know that the Property and Financial LPA can by your attorneys with your consent, whilst the Health and Welfare LPA only comes into play if you should ever lose your capacity.

Without one, your loved ones may have to go through a lengthy and costly court process to gain authority over your affairs. By setting up an LPA in advance, you ensure that your wishes are carried out smoothly and efficiently.

Discussing End-of-Life Wishes with Family

Beyond legal documents, it’s important to communicate your preferences for end-of-life care with your family. Topics to consider include:

  • Medical treatment preferences –Would you want life-sustaining treatment in certain situations?
  • Funeral Arrangements – Do you prefer burial or cremation? Would you like a specific type of service?
  • Legacy Planning – Are there charities or causes you’d like to support with a donation in your will?
  • Digital Legacy – What should happen to your social media accounts and online presence?

By having these discussions now, you reduce the emotional burden on your family and ensure that your final wishes are honoured.
