Motoring Offence Fees

Motoring Offences (Fee Structure).

Motoring offences include drink driving, speeding, driving without due care etc plus offences incorporated within the Road Traffic Act 1988 and s89 Road Traffic Regulation Act 1984.

Our basic charging rate is £180 (plus vat) per hour.

However our fixed fee structure is as follows:

1. Guilty pleas.

The fixed fee for a guilty plea is £450 plus vat.

Our fee includes:

  • 2 hours attendance/preparation
  • Taking your instructions
  • Providing advice on likely sentence
  • Attendance and representation at a single hearing at the Magistrates Court.

The fee does not include:

  • Instruction of any expert witnesses
  • Taking statements from any witnesses
  • Advice and assistance in relation to special reasons and exceptional hardship hearings
  • Advice or assistance in relation to any appeal

The key stages of your matter are based on the presumption you will plead guilty or have entered a guilty plea and have a date for your hearing.

  • Meet with your solicitor to provide instructions on what happened.
  • We will consider initial disclosure and any other evidence to provide advice.
  • Arranging to take witness statements if necessary (this will have an additional cost of £180 plus vat).
  • We will explain the court procedure to you so you know what to expect on the day of the hearing and the sentencing options available to the court plus the sentencing guidelines.
  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow up queries.
  • We cannot provide a timescale of when your hearing will take place as this is dependent on the court listing for that day.
  • We will attend court on the day and meet with you before going before the court. We anticipate being at court for half a day.
  • We will discuss the outcome with you. If advice is required on appeal against this will be subject to an additional cost.

There will be an additional fee of £250 plus vat to conduct special reasons and exceptional hardship hearings as part of the guilty plea hearing.

2. Not guilty pleas.

Our fixed fee for not guilty plea and listed for trial is £1000 plus vat on the basis of a one day trial.

There will a supplemental fee of £250 plus vat for each additional day of trial.

Our fee includes:

  • 4 hours attendance/preparation
  • Considering evidence
  • Taking your instructions
  • Providing advice on law and potential defence
  • Liaising with Court and Crown Prosecution Service

There may be an additional fee dependent on the complexity of the case.

  • Attendance and representation at the plea hearing and trial at the Magistrates Court.

The fee does not include :

  • Instruction of any expert witnesses
  • Taking statements from witnesses

The key stages of your matter are based on the presumption of entering a not guilty plea and proceeding to trial.

  • Meet with your solicitor to provide instructions on what happened.
  • We will consider all available evidence and provide advice.
  • Arranging to take witness statements if necessary (this will have an additional cost of £180 plus vat.
  • Instruct relevant expert witness. This will have a separate additional fee for the expert.
  • We will explain the court and trial procedure.
  • We will conduct further preparatory work, obtain your further instructions and answer any questions you may have.
  • We cannot provide a timescale of when your hearing will take place as this depends on the court and its listing of trials.
  • We will attend court with you to enter your not guilty plea and on the trial date.
  • We will discuss the outcome with you. If advice is required on appeal against conviction and/or sentence this will carry an additional cost.
